I have received a foreclosure notice from my mortgage company or bank If you have received a foreclosure notice from an attorney that represents your mortgage company you can try to negotiate a loan modification or a forbearance agreement or put your house up for sale.

If you owe more than your house is worth, you may have to do a short sale! Some Realtors are good at negotiating short pays or short sales, and I believe you will have to pick the right Realtor to be successful! Like all professionals, some are better than others! The best way to find out if your Realtor or lawyer is good, is to ask questions you already know the answers to!

Before you choose the lawyer or Realtor you want to work with, you must determine the value of your home! That's the most important thing. Even if you decide to call a bankruptcy attorney, that attorney will file his plan based on the value of your home! If you value your home too high, you may cost yourself a lot of money! If your attorney goes by what you say, then I am not so sure he is doing the best job possible! A good attorney will find out the value himself or hire an appraiser.

Whose job is it to find out the value? To tell you the truth, I am not so sure. I am sure if you do not find out the true "fast sale price" you could be losing a lot of money! So remember this. You have the most to lose, you have the most to gain! So it does not matter who is responsible or who should have or could have! What's most important is that you take responsibility for your future by making as many correct decisions as you can, and as soon as possible. In other words, the responsibility is yours!
